Has anyone heard about an atty actually setting up a "group" to sue Johnson and Johnson for the Charite Disc complications?
I can get a copy of it but was wondering if anyone else has heard of it and what everyone's take is on it. They state that it's been "failing" for 20 years in Europe and they are including Europe in their scope of area in which to take on clients. Thoughts?

The Ambulance Chasers are already advertising on television for these suits.....
and we wonder why a disc costs 11-12 thousand dollars..... J&J building up the legal fund.

I saw a commercial the other day for the office of J. Sokelove or something like that saying if you have had complications due to ADR with the Charite to contact them. I was surprised they were specifically targeting ADR already.

I am useless with technology so I don't know how to make this link work - it's a discussion on BrainTalk Spine Disorders forum. Not just the Charite ADR but apparently pedicle screws are also being targetted by the ambulance chasers.

I don`t understand how you do this in the USA but I was told by someone "I hear there will be a Class A law suit within 12 mths in the USA. This has come from top tiers of US spine surgeons and lawyers."
As far as I know its nothing to do with the actual discs its to do with poor treatment someone has had - - - -so far I think its just a "Whisper" maybe Gossip ,so no one take too much notice of it.

Yeah, I believe this could be targetted at newer surgeons who may not be particulary proficient yet. I had more than one doctor state that training and experience are very important due to the difficulty of this type of surgery. I think most of us have agreed that choosing the right doctor is more important even than the type of device.
I can imagine someone who is not in the know being told by their doctor they need ADR and not realizing how new this is here in the U.S. so not thinking to find out how much experience their doctor may or may not have. A lot of people still think of their doctors as a minor deity and will not question them, unfortunately.

Y'all,
In case you missed it, I started a topic specifically on this a while back, you can see it here. The individual FDA docs that you can find in the URL provided by Alastair (thanks!) are based on individual patients' experiences -- some of whom you have read about here. I wish I knew how many of these events were caused by Stenum; and/or improper device placement. If someone has some time, a careful reading & summary of those docs would be useful. PS: My lower back and Charite are great!

From what I can gather, it's been a matter of incorrect positioning the prosthesis, or using the wrong size end plates. I didn't read all of them but that's what it appears to be
